These terms and conditions form your agreement with Thame Fitness and apply to your purchase of all personal training sessions and classes. Your agreement is with Thame Fitness and not the trainer or instructor who delivers your training. Your instructions to commence personal training will constitute acceptance of these Terms and Conditions when you will become a client (a “Client” or “you”).
Your agreement with us is made up of your completed and signed Personal Training membership agreement form, these terms and conditions and the terms of studio use. These documents together form a legal agreement between us, so please make sure that you read them carefully and understand them. If you have any questions, please ask a member of our team at any club.
1. Purchasing Sessions and Bookings
Session purchases can be made online on the Thame Fitness website or inside the Acuity booking app.
When you purchase your personal training package, you can choose a package related to your preferred choice of Personal Trainer. You will be contacted within 24 hours of your purchase and we will inform you if we are able to accommodate your request or, alternatively, to discuss your personal goals and to allocate a Personal Trainer.
2. Trainer/Instructor Obligations
The Trainer/Instructor will use his/her skills and knowledge to design a safe programme of exercise that will take into account your lifestyle, personal goals, fitness levels and medical history. The Trainer/Instructor will provide the coaching, supervision, advice and support that you will need to achieve your goals. Apart from the initial consultation each personal training session will last 55 minutes (a “Session”). Each class will last 45 to 60 minutes (a “Class”).
3. Your Obligations
It is understood between you and your Trainer/Instructor that both must commit to your training programme 100% in order for you to achieve results in the safest manner as instructed.
You are required to arrive on time for each Session so that the Trainer’s full training plan is achieved on each visit.
You understand that the results of any fitness programme cannot be guaranteed. Your progress depends greatly on your effort and cooperation in and outside of the sessions and/or classes. In particular you acknowledge that individual results may vary and no particular result is guaranteed by your Trainer/Instructor.
All Client information will be kept strictly private and confidential. If you do not wish to be photographed for website, Facebook, or other advertising purposes please notify us in writing to be placed into your file otherwise we assume your full cooperation.
All payments must be made in full prior to any sessions being undertaken.
You should retain a copy of this agreement, the terms and conditions and digital receipt for any payment of session package purchases you make.
5. Session Cancellations
You can cancel or amend personal training session bookings from within your session confirmation email.
We require a minimum of 24 hours prior notice of any cancellation of any Personal Training session in order to allow you to reuse your session token. If you can cancel within 24 hours of your session booking you will lose that session token.
If you are late for your session, your session will be reduced in accordance with that time. If you are more than 25 minutes late, your Personal Trainer may choose to cancel the session and you may lose that session token.
7. Expiry and Extensions
All Personal Training package purchase options have a 150 day expiry, after which time any unused sessions will be lost and no refund will be made. This is to ensure we deliver all your required sessions to enable you to achieve your goals.
You may extend Personal Training packages for between six months and twelve full calendar months for the following reasons only:
– Serious illness
– Serious injury
To extend your Personal Training packs you must contact the studio; we may ask you to provide proof of pregnancy, serious illness, serious injury or redundancy. Any other extensions are entirely at the discretion of the studio general manager.
8. Trial Personal Training Session
As a prospective client, you may take part in 1 x Trial Personal Training Session. All Trial Personal Training Session bookings are non-transferable and all fees paid by you are non-refundable. If you fail to show up for a scheduled trial session, or you cancel a scheduled session more than 3 times, your booking fee will be lost.
9. Personal Trainer
If for any reason you are unhappy with your personal trainer, you may transfer to another personal trainer at any given time.
In all circumstances, any sessions used with the previous personal trainer remain used.
Your personal trainer cannot prescribe treatment or diagnose medical conditions. They may at any time ask to consult with your GP should any medical condition arise.
All purchases of personal training packages/classes are non-transferable and non-refundable.
If your personal trainer leaves the studio, no refund will be given and you will be assigned another personal trainer by the studio. Any other refunds are at the discretion of the studios General Manager.
11. Health and Safety
Your Trainer/Instructor has completed and holds a current certificate for CPR/AED First Aid. Thame Fitness has public liability insurance cover both for the studio, sports and classes practiced there-in, and any Thame Fitness workshop/club held outside of the premises.
If your Trainer conducts the Sessions on your private premises you are responsible for providing a safe exercise environment and the Trainer accepts no liability for injury due to an unsafe environment provided by you outside of the studio.
